RENTAL AGREEMENT

This Rental Agreement (this "Agreement") is being proposed on (Today's date:*) _______________ , by and between Paul House, ("Manager," Bozeman Cottage Inc Vacation Rentals, Inc., house is owned by Jim DiBerardinis, 3150 Graf Apt 8, Bozeman, MT 59715, "Owner"), and (Your Name:*) ___________________ ("Tenant"), address:* _____________________. The Agreement will become effective upon Tenant’s payment of the Reservation Deposit (see below), and expires 10 days from the above date if not received by Manager. The parties agree as follows:

PREMISES. Owner, in consideration of the rental payments provided in this Agreement, rents to Tenant a 3 bedroom, 3.5 bath house known as the Dolphin Lodge (the "Premises") located in Manzanillo, Costa Rica.

RENTAL AGREEMENT PAYMENTS. Tenant shall pay to Manager (Total Price:*)$ ____________ for the entire Agreement period. Agreement payments shall be made to Bozeman Cottage Inc, PO Box 562, Bozeman, MT, 59771. See Terms of Payments near the bottom of this page for information on reservation deposit, damage deposit, payment dates and cancellation policy.   Enter number of people you anticipate staying at the House* ____________ (this number is usually an estimate - price can be easily adjusted once you arrive).  Extra people beyond the standard 6 will be charged $140/person/week. 

KEYS.  Keys will be provided on-site by your caretakers, Rodolfo and Ofelia Goodman. The caretakers live next-door with their two children in an house behind the Coral Reef House.

LONG DISTANCE PHONE USE.  The phone at the house available for unlimited local use and all toll free use. There is a long distance block on the line which unfortunately blocks credit card calls as well. If you need a calling card I would recommend the MCI or Sprint cards which do not have connection charges or hidden taxes.

SMOKING/DRUGS. There is absolutely no smoking allowed indoors on the Premises. Illegal drug use will result in immediate eviction with no refund of rental payment.

CLEANING. The Premises shall be clean upon Tenant’s arrival. Agreement price includes four (4) hours of cleaning after your departure, which is sufficient for doing all bed linens and towels, vacuuming and light cleaning. Additional time spent cleaning may result in retention of part or all of the Damage Deposit.

PETS. No pets shall be allowed without the prior consent of the Manager.


LEGAL DETAILS:

FURNISHINGS. The rental of the Premises includes furnishings on the Premises. Tenant shall maintain all furnishings in as good as the condition at the beginning of the Agreement term, except for such deterioration that might result from normal use of the furnishings.

USE OF PREMISES/ABSENCES. Tenant shall occupy and use the Premises as a dwelling unit.

MAINTENANCE. Owner shall have the responsibility to maintain the Premises in good repair at all times.

ACCESS BY Owner TO PREMISES. Subject to Tenant's consent (which shall not be unreasonably withheld), Owner shall have the right to enter the Premises to provide necessary services. As provided by law, in the case of an emergency, Owner may enter the Premises without Tenant's consent.

UTILITIES AND SERVICES. Owner shall be responsible for all utilities and services in connection with the Premises.

HABITABILITY. Tenant shall inspect the Premises and furnishings upon arrival, and acknowledge that the Premises are in a reasonable and acceptable condition of habitability for their intended use, and the agreed Agreement payments are fair and reasonable. If the condition changes so that, in Tenant's opinion, the habitability and rental value of the Premises are adversely affected, Tenant shall promptly provide reasonable notice to Owner.

PROPERTY INSURANCE. Owner shall each be responsible to maintain appropriate insurance for the Premises and property located on the Premises. Tenant is responsible for insuring all personal property belonging to them.

DANGEROUS MATERIALS. Tenant shall not keep or have on the Premises any article or thing of a dangerous, inflammable, or explosive character that might substantially increase the danger of fire on the Premises, or that might be considered hazardous by a responsible insurance company, unless the prior written consent of Owner is obtained and proof of adequate insurance protection is provided by Tenant to Owner.

DEFAULTS. Tenant shall be in default of this Agreement, if Tenant fails to fulfill any Agreement obligation or term by which Tenant is bound.

ASSIGNABILITY/SUBLETTING. Tenant may not assign or sublet any interest in the Premises without the prior written consent of Manager, which shall not be unreasonably withheld.

NON-SUFFICIENT FUNDS. Tenant shall be charged $15.00 for each check that is returned to Manager for lack of sufficient funds.

ENTIRE AGREEMENT/AMENDMENT. This Agreement contains the entire agreement of the parties and there are no other promises or conditions in any other agreement whether oral or written. This Agreement may be modified or amended in writing, if the writing is signed by the party obligated under the amendment.

SEVERABILITY. If any portion of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

CUMULATIVE RIGHTS. The rights of the parties under this Agreement are cumulative, and shall not be construed as exclusive unless otherwise required by law.

GOVERNING LAW. This Agreement shall be construed in accordance with the laws of the State of Montana.

 

TERMS OF PAYMENTS

Reservation Deposit:  The 25% reservation deposit shall be paid to Paul House (Manager) at the time of the reservation and payment will be held by the Manager to be applied toward the remaining balance.  For reservations made within 30 days of your arrival date, the total amount is due unless other arrangements have been made. 

Damage Deposit: Either a check or credit card may be used for the Damage Deposit. If using a check, please send to Manager prior to arrival and the check will be held but not cashed unless needed for damages. If using a credit card, Manager must have your credit card info on file, and reserves the right to charge that credit card should damage compensation be needed. No charges will be placed on the credit card unless needed to compensate for damages to the Premises during Tenant’s rental period.

Remaining Balance: 30 days before commencement of the rental I’ll send you a reminder to pay the remainder of the Agreement payment.   If you paid the reservation deposit by credit card, I will automatically charge the balance to the same card unless otherwise instructed. This shall also be held by the Manager until commencement of the rental.

Cancellations: Any cancellation made 60 days or more before the scheduled arrival date will receive a full refund of the reservation deposit, less a $75 cancellation fee. Any cancellation made within 60 days of the scheduled arrival date shall be subject to a forfeiture of the Agreement payment(s), unless the Manager is able to re-rent the Premises for the reserved dates.  Since we can't control the weather, cancellations for rain, flooding, road closures, etc are still considered cancellations.  Please see link at top of page for travel insurance. 

Tax:  All taxes are included in the rental price.

* For non-US payments there is a 1% surcharge for credit card transactions.  If you need to process a payment with a credit card from a country other than the US, then you will be charged the surcharge.  Other options are check in the mail or bank transfer.

    NOTE:  Both houses are reached by walking or biking 200 meters beyond the end of the road, along the ocean on a sand beach road.  You may drive in to unload your luggage and supplies, but regulations prohibit cars to be left inside the refuge after your luggage has been delivered.  There is also a small creek to cross which during dry conditions can be anywhere from 0-8" deep depending on the tide, and if there has been recent rainfall it can be deeper, adding an adventurous aspect to your experience!
    If you see the creek wading, a short walk along the beach and the rustic secluded nature of the setting as an asset, then our two lodges are for you. But if you are looking for a resort setting with daily services then there are many fine resort hotels in Costa Rica for you.  After a hard rain storm and on rare occasions, you might have to  take a boat across the channel. Usually it is not more than shin deep, and  you can walk to town in 10 min. Since the houses are literally located under the forest canopy facing the beach with little other development, you hear the never-ending sounds of the nature, the forest and animals.
  
Most of the bugs you will encounter are mosquitoes and harmless spiders. At night the sand flies come out and you should protect yourself with repellent and long pants and sleeves, if you plan to walk on the beach after dark. As long as you watch where you step and don’t reach out to touch everything you’ll most likely be fine. You’ll learn about all the creatures of the forest if you take a jungle tour with one of the highly trained guides, and then you’ll feel more comfortable.  People hike on the local trails most everyday without incident. For people that have medical conditions, allergies or other aversions to plants and insects, consult your doctor or local health department for health information.
    Our guests that seem to get the most pleasure out of their experiences, are people who spend time in the outdoors, appreciate raw nature at its best and those that are looking for a unique situations We have plenty of demand from guests to rent the houses, therefore we try hard to match our guest with best situation for them. When we're successful at that then everyone is extremely satisfied, as you can see from the reviews. To meet that goal, the Owner prefers to talk to each inquiring party to make sure they understand as much as possible about the houses.
