RENTAL AGREEMENT

Note: any changes made to this agreement other than adding information into the underlined fields must be in Bold or ALLCAPS

This Rental Agreement (this "Agreement") is being proposed on (Today's date:*) _______________ , by and between Paul House, ("Reservation Manager," Bozeman Cottage Inc Vacation Rentals, Inc.), and (Your Name:*) ________________________________ ("Guest"), address:* ___________________________________________________. The Agreement will become effective upon Guest’s payment of the Reservation Deposit (see below), and expires 3 days from the above date if not received by Reservation Manager. The parties agree as follows:

PREMISES. Owner, in consideration of the rental payments provided in this Agreement, rents to Guest a studio loft with 1 bathroom (the "Premises") known as the Historic Downtown Loft at 425 S Black Ave, Bozeman, MT, 59715.

TERM. The Agreement term will begin on (Check In date:*) ____________ at 4 PM, and will terminate on (Check Out date:*) _____________ at 10 AM.  Please write in your estimated arrival time: ____________ and departure time: ____________ Unapproved late departures resulting in delaying the cleaning crew will be charged their hourly rate of $50/hour.  

RENTAL AGREEMENT PAYMENTS. Guest shall pay to Owner (Rental Price:*)$ ____________ for the entire Agreement period, not including the State of Montana bed tax of 7% of Rental Price ($ _______) and cleaning fee of $65;
Total Price $ _____________. Agreement payments shall be made to Bozeman Cottage Inc, PO Box 562, Bozeman, MT, 59771. See Terms of Payments near the bottom of this page for information on reservation deposit, damage deposit, payment dates and cancellation policy.   Enter number of people you anticipate staying at the House* ____________ (this number is usually an estimate - price can be easily adjusted once you arrive).  Extra people beyond the standard 2 will be charged $105/person/week.  List names of all guests here: *_______________________________________________________________________________________.

KEYS. A keyless entry lock on the front door will be programmed shortly before your arrival. Your passcode will be provided upon payment along with directions to the house

CLEANING DEPOSIT. The Premises shall be clean upon Guest’s arrival. One week prior to check in date, a $200 cleaning deposit will be reserved on Guest's credit card (See Cleaning Deposit section under Terms of Paymenst below for payment procedure).  Agreement price includes three hours of cleaning which is sufficient for doing all bed linens and towels, vacuuming and light cleaning. Additional time spent cleaning may result in retention of part or all of the Cleaning Deposit.  Prior to checkout, Guest should strip beds and leave the linens piled on the bed, pick up all garbage, wash dishes and wipe down kitchen.  Failure to do so will likely result in extra cleaning time which you will be charged for.  Initial here to signify that you have read and understand the terms of the Cleaning Deposit *________

DAMAGE DEPOSIT. Guest will be responsible for any damage caused by Guest’s use of the Premises. This includes any damage caused by anyone in Guest’s party or anyone on the premises at the Guest’s invitation or sufferance. Guest agrees that any damage may be charged to his/her credit card and submits to the jurisdiction of the appropriate Montana Court if litigation is necessary.  See Damage Deposit section under Terms of Payments below.

PETS. No pets shall be allowed without the prior consent of the Owner.

SMOKING. There is absolutely no smoking allowed indoors on the Premises.

OCCUPANCY & RESTRICTIONS. Only the number of people specified above may occupy the Premises.  No guests or visitors may stay in RVs parked on the premises. Gatherings of more than 10 people in addition to the guests constitute an event that the Reservation Manager must be notified about in advance and approve to minimize neighborhood impacts; there may be an extra charge.  No bands may perform on Premises. No discharge of any firearm or hunting of any kind is allowed on Premises. Any illegal activity may result in immediate eviction and forfeiture of rent received. No commercial use of the house is allowed for any purpose.  Guest may not sublet the Premises. Guest agrees to abide by Reservation Manager’s House Rules found in “Guest Book.”  Guest will not make any alterations, remove anything, or do any repair without prior approval of Reservation Manager. Home Owner or Reservation Manager may enter at reasonable times for repairs or service. Home Owner or Reservation Manager is not responsible for any loss or damage to Guest’s property. This wavier by Guest includes any loss, expense or damage, whether direct, indirect, consequential or otherwise.

 

ACCESS TO PREMISES BY OWNER OR MANAGER.  The Owner, Manager or agents thereof may access the Premises for reasons of urgent repair or maintenance of the Premises. 

LONG DISTANCE PHONE USE. The phone at the house is available for unlimited domestic calls (no long distance charges apply for calls within the US).  

DEFAULT. Guest shall be in default of this Agreement if Guest fails to fulfill any Agreement obligation or term by which Guest is bound.

 

LIABILITY FOR DAMAGE, INJURY, OR ILLNESS.  Owner of Property will not be liable for any damage or injury or illness to Guest or any other person or to any property occurring on the premises or in common areas unless such damage is the legal result of the negligence or willful misconduct of the Owner of the Property.  Guest agrees to hold the Owner of the Property harmless from any claims no matter how caused except for injury or damages caused by negligence or willful misconduct of Owner of the Property. 

 

ARBITRATION CLAUSE.  Arbitration shall be sought in any proceeding not settled by the parties. 

 

ENTIRE AGREEMENT/AMENDMENT. This Agreement contains the entire agreement of the parties. This Agreement may be modified or amended in writing, if the writing is signed by both parties.


DANGEROUS MATERIALS. Guest shall not keep or have on the Premises any article or thing of a dangerous, inflammable, or explosive character that might substantially increase the danger of fire on the Premises.

 

GOVERNING LAW. This Agreement shall be construed in accordance with the laws of the State of Montana.  If any action in law or in equity shall be brought to recover any rent or charge under this Lease, or for or on account of any breach of, or to enforce or interpret any of the covenants, terms or conditions of this Lease, or for the recovery of the possession of the demised Premises, the prevailing party shall be entitled to recover from the other party as part of the prevailing party's cost, reasonable attorney's fees, investigation, affirming judgments or appeal, the amount of which shall be fixed by the court and shall be made a part of any judgment or decree hereof rendered.  The prevailing party will also be able to recover the cost of collection of those judgments.

 

TERMS OF PAYMENTS

RESERVATION DEPOSIT. The 25% reservation deposit shall be paid to Bozeman Cottage, Inc. at the time of the reservation and will be held by the Reservation Manager to be applied toward the remaining balance. For reservations made within 30 days of your arrival date, the total amount is due unless other arrangements have been made.

 

REMAINING BALANCE. 30 days before commencement of the rental, Reservation Manager will send you a reminder to pay the remainder of the Total Price. If you paid the reservation deposit by credit card, Reservation Manager will automatically charge the balance to the same card unless otherwise instructed.  If you paid by check or VRBO then a reminder will be sent to you. 

 

CLEANING DEPOSIT.  Manager will reserve funds in the amount of $200 on Guest's credit card one week prior to check in date, or funds maybe paid by check, prior to arrival and released within 48 hours after your departure provided that no extra cleaning or damages were incurred. 

 

DAMAGE DEPOSIT. Manager will use Guest's credit card for the purpose of securing a damage deposit.  Damage deposit will be used if necessary to repair damage to the Premises.  The card will not be charged unless necessary. 

 

CANCELLATIONS & CHANGES. Any cancellation made 60 days or more before the scheduled arrival date will receive a full refund of the reservation deposit, less a cancellation fee of $75 plus credit card fees of 2.5% of any amount that has been charged to your card. Any cancellation made within 60 days of the scheduled arrival date shall be subject to a forfeiture of the Agreement payments (including the remaining balance payment), unless the Reservation Manager is able to re-rent the Premises for the reserved dates at an equivalent rate minus any cleaning costs and extra work incurred by the cancellation.
 

ACCOMMODATIONS TAX. The State of Montana collects a 7% bed tax on all home rentals less than one month in duration.

 

PAYMENT INFORMATION & OPTIONS, Four methods to choose from:

1.  Free electronic funds transfer.  My payment hub page is Here, and more info is posted on my Dwolla payment page.  Setting up a Dwolla account is free and easy, but does take a few days to verify your bank account.  The company is basically trying to subvert the credit card industry's $50 billion per year profits by charging only 25 cents per transaction instead of 2-3% of the total amount charged.

* For non-US payments there is a 1% surcharge for credit card transactions.  If you need to process a payment with a credit card from a country other than the US, then you will be charged the surcharge.  Other options are check in the mail or bank transfer.
