The Agreement will become effective upon Guest’s payment of the Reservation Deposit (see below), and expires 10 days from the above date if not received by Reservation Manager. The parties agree as follows: PREMISES. Owner, in consideration of the rental payments provided in this Agreement, rents to Guest 5 bedroom, 3.5 bath house known as the Spring Creek House (the "Premises") located at 2010 Spring Creek Drive, Bozeman, MT, 59715. The Agreement term will begin on (Check In date:*) ____________, and will terminate on (Check Out date:*) _____________ at the usual check-in time of 5 pm and check-out time of 10 am, unless other arrangements have been made in advance. We can usually be flexible with arrival and departure times, if needed, as long as your reservation is not back to back with another one. Guest shall pay to Owner (Total Price:*)$ ____________ for the entire Agreement term, including the State of Montana bed tax of 7% (prices listed already include that tax). Payments shall be made to Bozeman Cottage Inc, PO Box 562, Bozeman, MT, 59771. These pricing schedules are specific to the size of your party because of the large capacity of the houses and our desire to not overcharge smaller parties. Often it is difficult to predict how many people may join your party and therefore we commonly balance the final charge, even up to your departure day when we know how many people to charge for. The price changes by $15/person/night. Please do not try to have more people than you've paid for - we end up finding out anyway and it just gets embarrassing when I have to confront you about it. A keyless entry lock on the front door will be programmed before your arrival. Your passcode will be provided by the owner, along with directions to the house.LONG DISTANCE PHONE USE. Long distance calls within the U.S. and Canada can be made from the house line. No international calling (other than calls to Canada) is allowed. Any international calls that show up on the bill will be charged to the renter, along with a $10 fee.SMOKING. There is absolutely no smoking allowed indoors on the Premises. Cigarette butts must absolutely be placed in the numerous sand buckets placed near the doors, and NOT disposed of on the ground or in the mulch.OCCUPANCY & RESTRICTIONS.
Only the number of people specified above may occupy (i.e. sleep at) the
Premises. The house sleeps 12-15 adults at the maximum (with room for up to 12
adults on 6 beds and 1 futon sofa/bed, and 3 additional adults/teens/children on
smaller portable foam beds. In addition, the house can accommodate up to three
infants/toddlers (the house has 2 portable playpens and 1 stationary crib), plus
1 additional small child of approximately 8 or younger (on a love seat sized
futon sofa/bed).
ACCESS TO PREMISES BY OWNER OR MANAGER. The Owner, Manager or agents thereof may access the Premises for reasons of urgent repair or maintenance of the Premises.
DANGEROUS MATERIALS. Guest shall not keep or have on the Premises any article or thing of a dangerous, inflammable, or explosive character that might substantially increase the danger of fire on the Premises. No fireworks (see above under Restrictions). PETS. No pets shall be allowed on the premises. CLEANING. The Premises shall be clean upon Guest’s arrival. Agreement price includes 6-8 hours of cleaning which is sufficient for doing all bed linens and towels, vacuuming and light cleaning. Additional time spent cleaning may result in retention of part or all of the Damage Deposit. DAMAGE. Guest will be responsible for any damage caused by Guest’s use of the Premises. This includes any damage caused by anyone in Guest’s party or anyone on the premises at the Guest’s invitation or sufferance. Guest agrees that any damage may be charged to his/her credit card and submits to the jurisdiction of the appropriate Montana Court if litigation is necessary.
DEFAULT. Guest shall be in default of this Agreement if Guest fails to fulfill any Agreement obligation or term by which Guest is bound.
ENTIRE AGREEMENT/AMENDMENT. This Agreement contains the entire agreement of the parties. This Agreement may be modified or amended in writing, if the writing is signed by both parties.
GOVERNING LAW. This Agreement shall be construed in accordance with the laws of the State of Montana. If any action in law or in equity shall be brought to recover any rent or charge under this Lease, or for or on account of any breach of, or to enforce or interpret any of the covenants, terms or conditions of this Lease, or for the recovery of the possession of the demised Premises, the prevailing party shall be entitled to recover from the other party as part of the prevailing party's cost, reasonable attorney's fees, investigation, affirming judgments or appeal, the amount of which shall be fixed by the court and shall be made a part of any judgment or decree hereof rendered. The prevailing party will also be able to recover the cost of collection of those judgments.
TERMS OF PAYMENTS RESERVATION DEPOSIT. The 25% reservation deposit shall be paid to Bozeman Cottage, Inc. at the time of the reservation and will be held by the Manager to be applied toward the remaining balance. For reservations made within 30 days of your arrival date, the total amount is due unless other arrangements have been made.
DAMAGE DEPOSIT. Manager will use Guest's credit card for the purpose of securing a damage deposit. Damage deposit will be used if necessary to repair damage or to perform extra cleaning. The card will not be charged unless necessary.
REMAINING BALANCE. 30 days before commencement of the rental, Manager will send you a reminder to pay the remainder of the Agreement payment, as well as accommodations tax. If you paid the reservation deposit by credit card, Manager will automatically charge the balance to the same card unless otherwise instructed.
CANCELLATIONS
& CHANGES. Any
cancellation made 60 days or more before the scheduled arrival date will receive
a full refund of the reservation deposit, less a $75 cancellation fee. Any
cancellation made within 60 days of the scheduled arrival date shall be subject
to a forfeiture of the Agreement payments (including the remaining balance
payment), unless the Manager is able to
re-rent the Premises for the reserved dates at an equivalent rate.
ACCOMMODATIONS TAX. The State of Montana collects a 7% bed tax on all home rentals less than one month in duration. The tax is applied to 75% of the rental amount and is included in the price of the rental (reservation administration fees of 25% of rental amount not taxable).
