RENTAL AGREEMENT

Note: any changes made to this agreement other than adding information into the underlined fields must be in Bold or ALLCAPS

This Rental Agreement (this "Agreement") is being proposed on (Today's date:*) _______________ , by and between Bozeman Cottage, ("Reservation Manager," Bozeman Cottage Inc Vacation Rentals, Inc.), and "Guest"* ________________________________ , address:* __________________________________________________. Cell phone # ____________ and/or Bozeman contact phone # ____________ .  Guest may not sublet the house, formally or informally, to any others in the course of the rental.  The Agreement will become effective upon Guest’s payment of the Reservation Deposit (see below), and expires 3 days from the above date if not received by Reservation Manager. The parties agree as follows:

PREMISES. Owner, in consideration of the rental payments provided in this Agreement, rents to Guest 5 bedroom, 3.5 bath house known as the Spring Creek House (the "Premises") located at 2010 Spring Creek Drive, Bozeman, MT, 59715.

TERM. Per City of Bozeman regulations, rental contracts for houses in R-1 zoning areas are written for periods of 30 days or over. The term covering your rental will begin on __________ and will terminate on ____________. 

RENTAL AGREEMENT PAYMENTS. Guest shall pay to Owner (Total Price:*)$ ____________ for the entire Agreement term based on the number of people and occupation estimates below and discussed with Bozeman Cottage.  Enter number of people you anticipate staying at the House* adults: ________  children and ages: _________________________________  (you may need to estimate at this point).  Exact details will be checked before final billing, and altered according to the information given during preliminary discussions.  Price can and will be easily adjusted based on actual occupancy numbers).

KEYS. A keyless entry lock on the front door will be programmed before your arrival.  Your passcode will be provided by the owner, along with directions to the house. 

LONG DISTANCE PHONE USE.  Long distance calls within the U.S. and Canada can be made from the house line. No international calling (other than calls to Canada) is allowed. Any international calls that show up on the bill will be charged to the renter, along with a $10 fee.

SMOKING. No smoking anywhere on the property.

OCCUPANCY & RESTRICTIONS Guest may not sublet the house, formally or informally, to any others in the course of the rental.  Only the number of people specified by you above (in RENTAL AGREEMENT PAYMENTS) may sleep at the house without contacting the owner.  Additional sleeping space (beyond 2 queens, 2 doubles, and 2 twins) consists of a sofa bed, 3 portable foam beds, and a double futon + a small futon in the family room. There is also room for up to 3 infants (stationary crib + 2 portable playpens).

No overnight parking of RVs or camper trailers.  No tents (for sleeping or for parties) may be set up on the property without checking with the owners.  In order to minimize neighborhood impact, parties at the house can be no larger than 25 people (adults and children), including the group staying at the house.  Gatherings of more than 10 people in addition to the guests constitute an event that the owners must be notified about in advance and approve. 
No bands may perform on Premises, but some live music would be acceptable if cleared in advance with the owners.  No shooting off of fireworks on the premises.  No discharge of any firearm or hunting of any kind is allowed on Premises. Any illegal activity may result in immediate eviction and forfeiture of rent received. No commercial use of the house is allowed for any purpose.  Guest may not sublet the Premises. Guest agrees to abide by Owner’s House Rules found in “Guest Book.” Guest acknowledges that there is wildlife in the area and will not disturb them and will treat them with appropriate caution due wild animals. Guest will not make any alterations, remove anything, or do any repair without prior approval of Manager.  Owner or Reservation Manager may enter at reasonable times for repairs or service. Owner or Reservation Manager is not responsible for any loss or damage to Guest’s property. This waiver by Guest includes any loss, expense or damage, whether direct, indirect, consequential or otherwise.

 

ACCESS TO PREMISES BY OWNER OR MANAGER.  The Owner, Manager or agents thereof may access the Premises at reasonable times for repairs or service.  

 

DANGEROUS MATERIALS. Guest shall not keep or have on the Premises any article or thing of a dangerous, inflammable, or explosive character that might substantially increase the danger of fire on the Premises.  No fireworks (see above under Restrictions).

PETS.  No pets are allowed in the house, staying or visiting. 

CLEANING. The Premises shall be clean upon Guest’s arrival. Agreement price includes time necessary for laundry and cleaning at the end of your stay, including vacuuming. Our experience shows that 8-9 hrs (or as little as 5 hrs) is sufficient, even for large groups.  10 hours and more cleaning time will be charged at $20/hr.  If the carpets need spot or traffic area cleaning resulting from your stay, there will be a carpet cleaning charge.  The carpet cleaner's minimum service call is $90.

 

DAMAGE. Guest will be responsible for any damage or excess cleaning caused by Guest’s use of the Premises. This includes any damage caused by anyone in Guest’s party or anyone on the premises at the Guest’s invitation or sufferance. Guest agrees that any damage may be charged to his/her credit card and submits to the jurisdiction of the appropriate Montana Court if litigation is necessary.

 

DEFAULT. Guest shall be in default of this Agreement if Guest fails to fulfill any Agreement obligation or term by which Guest is bound.

 

ENTIRE AGREEMENT/AMENDMENT. This Agreement contains the entire agreement of the parties. This Agreement may be modified or amended in writing, if the writing is signed by both parties.

 

GOVERNING LAW. This Agreement shall be construed in accordance with the laws of the State of Montana.  If any action in law or in equity shall be brought to recover any rent or charge under this Lease, or for or on account of any breach of, or to enforce or interpret any of the covenants, terms or conditions of this Lease, or for the recovery of the possession of the demised Premises, the prevailing party shall be entitled to recover from the other party as part of the prevailing party's cost, reasonable attorney's fees, investigation, affirming judgments or appeal, the amount of which shall be fixed by the court and shall be made a part of any judgment or decree hereof rendered.  The prevailing party will also be able to recover the cost of collection of those judgments.

 

 

TERMS OF PAYMENTS

RESERVATION DEPOSIT. The 25% reservation deposit shall be paid to Bozeman Cottage, Inc. at the time of the reservation and will be held by the Manager to be applied toward the remaining balance. For reservations made within 30 days of your arrival date, the total amount is due unless other arrangements have been made.

 

DAMAGE DEPOSIT. Manager will use Guest's credit card for the purpose of securing a damage deposit.  Damage deposit will be used if necessary to repair damage or to perform extra cleaning.  The card will not be charged unless necessary. 

 

REMAINING BALANCE. 30 days before commencement of the rental, Manager will send you a reminder to pay the remainder of the Agreement payment. If you paid the reservation deposit by credit card, Manager will automatically charge the balance to the same card unless otherwise instructed.

 

CANCELLATIONS & CHANGES. Any cancellation made 60 days or more before the scheduled arrival date will receive a full refund of the reservation deposit, less a cancellation fee of $75 plus credit card fees of 2.5% of any amount that has been charged to your card. Any cancellation made within 60 days of the scheduled arrival date shall be subject to a forfeiture of the Agreement payments (including the remaining balance payment), unless the Reservation Manager is able to re-rent the Premises for the reserved dates at an equivalent rate.
    Once the reservation is finalized, changing houses and/or dates, if possible, costs $25. 

 

ACCOMMODATIONS TAX. Not applicable to this rental since the rental period is over 30 days in duration.

* For non-US payments there is a 1% surcharge for credit card transactions.  If you need to process a payment with a credit card from a country other than the US, then you will be charged the surcharge.  Other options are check in the mail or bank transfer.
